XBOX Refund Eligibility

I would like some clarification on the following

Refunds are typically issued for requests meeting the following criteria:

Requests are made within 14 days of the purchase date

Requests are for games in which you haven’t accumulated a significant amount of play time

My son recently bought a game, for an Xbox 360 (he has a Xbox S). He didn't mention this to me, until past the 14 day time period (this is annoying but he'd just been playing something else).

I explained that, he hadn't played the game (and couldn't for that matter), so it should be okay. I requested a refund for him but it was refused based on point 1. I feel like point 2 is applicable to him and therefore a refund should be allowed. Which he will just spend on another game anyway.

You can't really get a refund because it's in game coins which does not give you the choice to refund.

If he bought a game then it would be a differnt story.

Just recieved email regarding billing escalation from support , stating open case and reference no. Whatever that means. My god they make things very difficult. Guy over phone was a complete unhelpful twat. Any see how it goes.
