    Recently I was comm banned from xbox live for 2 weeks (not this account). Why you may ask? Because I sent a message to a friend saying "[Mod Removed]". The purpose of this post is to outline why calling someone gay is objectively not homophobic.

    I'll start off by giving everyone some context. My friend has recently made a new account and invited to his party. I was previously in another party and so i told him that i would join that one back and invite him. As i knew that he was not going to use
    that account for very long or saw no purpose in friending it and so i sent him a message to gain quick access the his gamercard. The message being what was stated above. After that message I sent "jk ily". He joined my party and as a joke reported me (he was
    not offended in any way, shape or form) because he didn't think that i would get banned (why he didn't just pretend to ban me idk,, he said that he didn't think about that at the time). After about 30 seconds i get a notice of enforcement action from xbox
    live. I tell my friend and as evidence that he was not offended he sent me two more messages so that I could use them as proof during the case review. The messages were along the lines of "sorry for reporting you" and "ily". So this means that no-one was offended
    and no harm was caused; however after my case review had been submitted I was informed that the decision was upheld and that it was due to a homophobic message. The review stated that that sending that message even in a joking way was unacceptable and is demeaning
    due to them being singled out due to their sexually. However the person was not demeaned as they were not offended in anyway. It appears to me that the enforcement team misunderstood this (unless it censorship rather than a punishment because of an offense).
    Context and intent matters.

    Calling someone gay is not homophobic for two reasons. The first one being that it is a pure word, it has no negative connotation. By that I mean that the word is merely used to accurately describe a persons sexually, it is not derogatory or demeaning in
    any way (other similar words are). A homosexual describes themselves as gay and they can't possibly be homophobic which means that the word isn't. The second reason builds off of the first. That it has no negative connotations. In the message I never said
    you are gay and that is bad (I would never say that as i believe that everyone deserves to be treated equally). This means that I have not added a negative connotation to the statement and the word has no negative connotation. This immediately means that it
    cannot be demeaning as it has no negative weight. This then means that it is not singling out a single individual based on their sexually in order to demean them as the word is not demeaning.

    There are only two ways that calling someone gay can have a negative connotation.

    1. That the statement is meant purely as an insult in order to demean someone. This means that there is a perceived "and that is bad" (or something like that) at the end of the statement. There is no way that the xbox enforcement team could know my intent
    without message prior to it (which there weren't) and so they cannot assume that it is being used as an insult (innocent until proven guilty). Not only that but I had informed the xbox enforcement team that it was to a friend and that it was a joke and therefore
    it cannot be meant as an insult.

    2. That the person that reads the statement applies a negative connotation to the word themselves. This inherently means that the person is either intentionally or unintentionally being homophobic. This is exceptionally hypocritical as that it what i am
    being banned for. (I believe this to be the case for my ban although if xbox enforcement team were to contact me I would be more than happy to discuss it.

    Xbox Live Enforcement Team if you happen to read this post then please post below and I will give you my other account's gamertag and my email address if you so wish. I hope that we can contact each other further to resolve this issue.

    I would like to finish off by saying that this could have potentially been avoided if there was a live chat to discuss the ban this would both allow the xbox live member to better explain themselves, the context and their perspective on the situation as
    well as the enforcement team being able to better explain to the xbox member what their perspective is. This would significantly strengthen communication and allow for more fair bans. (Yes I know that there is the community enforcement thing but they still
    wouldn't have the context and perspective of the member)

    Xbox enforcement team please read!

    Hi, I know you're upset, but I'm not sure you will get a direct answer from them. Just file a complaint for that user via the tools on your console. It will be looked at, it just takes a little time.

    If you go to that persons profile, you will see the option to report etc.

    Good luck and also block communications with that player.

    Please Read Xbox Enforcement Team

    The enforcement team do not use the forums.

    If you have filed for a case review & the decision was upheld then there is nothing you can do.

    As per the ToU/CoC you agreed to the enforcement team are under no obligation to show you specific evidence that they have.

    if you read the terms of use you aren't supposed to use sexuality on the xbox pan etc

    No no unmoderated chat for two reasons first you only get one chance anymore ias harassment

    And it would be spammed so much no one would be helped

    There is a reason why moderated chat is the most supported for enforcement on any console

    Also that kind of talk isn't excusable one

    You are supposed to keep it clean

    Rated e for everyone regardless of who started it

  5. If you are going to post a response please make sure it actually makes sense and has atleast some grammar. Your words are just everywhere and you dont have a single full stop. Its just an absolute mess. Second of all did you even read my post? At no point
    do i talk about removing moderation. Also the TOS are to not single somebody out based on their sexuality not to never talk about it. On to the last point you have no idea what you are talking about. I spent the half of my post talking about how it isnt offensive
    and how it was clean. Also no-one started anything, the message was to a friend who reported me jokingly, there was no malicious intent anywhere. Please dont ever post a response like that again, it was disgraceful.

    It must be rated e for everyone

    It doesn't matter if it's a joke you cannot use sexuali terms on xbox live or any network

    Pretty sure even a grade 2 can understand what rated e for everyone is

    Calling someone that only has one meaning and it is not nice or allowed even in school or g rated movies

    Game ratings only affect single player aspects and only prevents kids from buying it not playing it

    You can use adult language... Yes an m rated game does mean i can use adult language. It restricted to 17+ its not my fault an underage child is playing it, they know what they are getting into when you play a game with that rating. Its like saying that
    bars cant serve alcohol because a kid may illegaly get in. Everyone over the age of ten swears, i have my right of freedom of speech to swear in a private party with friends that i know wont be offended but thats is off topic and has nothing to do with the
    situation. Where are you getting must be rated e from? If the xbox community was rated e then there would only be minecraft and roblox. You have no idea what you are talking. lastly i spent half my post talking about why calling someone gay is not offensive
    or derogatory and yet you refuse to acknowledge let alone dispute it. Also yes at my school you could call someone gay. And lastly your right, it doesnt matter that it is a joke because even if it wasnt my friend that i sent the message to was not offended

    No you cannot. The code of conduct you agreed to when you made your account prohibits adult language and no just because it is rated M does NOT mean you can use adult language. Nor does it mean that someone underage cant play it. It only means someone underage
    cant buy the game without an adult. That is it.

    "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress

    The first ammendment only applies to congress or the government not being able to censor what you say. However this does not apply to private networks or companies. They are free to enforce their own rules which can include censoring what you say. This is
    something that has already been ruled by the United States Supreme court as perfectly legal and constitutional to do.

    Here is a small snippet from the code of conduct with example of communications that are prohibited on Xbox Live:

    • Content that could harm or harass a person, including yourself, or an animal. For example:
      • Profane words or phrases
      • Suicide-related content
      • (Note: the examples below are just a few examples of the type of behavior prohibited by the Microsoft Code of Conduct. Just because something isn't on this list doesn't mean it's OK.)
      • Negative speech (including hate speech or threats of harm) directed at people who belong to a group, including groups based on race, ethnicity, nationality, language, gender, age, disability, veteran status, religion, or
        sexual orientation/expression
