Xbox Account still saying its a child one even after upgrading account

sorry to hear. Sometimes the Network Need some time to push the new data to all Servers. You can edit your security settings also via

account.microsoft.com. But often a power cycle help too to update and refresh your data, so try this:

1. Turn off the Xbox One console by pressing the Xbox button on the front of the console for about 10 seconds until it shuts down completely.
   
2. Unplug the console's power cable. Wait 30 seconds.
   Important Be sure to wait 30 seconds. This step resets the power supply. Maybe it is also a good idea to reset you modem/router via On/Off switsch too.
   
3. Plug the console power cable back in.
4. Press the Xbox button on your console to turn on the Xbox One.

You will either have to download the game on an Xbox 360 or upgrade your account to an adult.

yes home console setting changed the mechanism

change child account to adult account still does not work - I can remove the child from family and add it as adult but when I remove the account from family this account cannot login on its Xbox One S without a parental permission even the account is not
part of a family anymore - thats strange

why I want to remove the account from family: its because this account cannot download Xbox 360 gold games - always getting "Your account is unable to make this type of purchase on Xbox.com. Please complete this transaction from your Xbox" - support page
says I have to download the game from Xbox 360 but only Xbox One S is available also tried that via browser - still not working.

did anyone experience something similiar?

Is it perhaps set up as a child beforehand? If your account is previously set as a child, it will still remain as a child even after changing your birthdate.

Child accounts

An Xbox LIVE child account can move to a new region even if the parent account stays in its original region. But the parent will still have to accept the Terms of Use in the new region on the child’s behalf.

If the child is a minor (as defined by applicable law) in one region but isn’t a minor in the other region, the account can’t be moved between those regions.

Looks like as per the second paragraph, it doesn't seem to be possible. You may have to wait until you are 18.
