Xbox 360 and original games from Gold

Sorry to hear that you're dealing with this issue trying to get Republic Commando.

This could be happening because of the
Xbox Live Status Service Alert we have currently affecting our platforms, so I would suggest trying after it has been resolved.

After it has been, see if you can try again or if you can try online at Xbox.com after signing in.
I'm not sure if you have or not, but I think it might be best for you to try the claim for this game off of a 360 console instead. This being because the 360
consolecan communicate better with
360 marketplace
than the XboxOne, that has to access it through an emulator.

When you get a chance, give those steps a shot and let us know how that helped resolve the issue.

That message can also come up if you're on a child account. Due to restrictions on child accounts, they can only make purchases for backwards compatible titles on a 360 console.

for 360 content a valid payment option needs to be available on the Microsoft Account as verification for the purchase, it will not be charged. The payment option needs to match the account region. The account region/country can be found on this link:

https://live.xbox.com/Account/BillingAccountInformation

So be sure to check if all is set up correctly and account, payment option and console region (on Xbox One) are set to the same country

Side note: a trial subscription will not work to acquire Xbox 360 Games with Gold games only a normal (paid) subscription will.

The original Xbox games have always been classified as the 360 Games with Gold. So you've never needed Gold to keep playing those. It's only the One games that have required Gold.

If you mean the current Games with Gold game for the 360, it's actually an original Xbox game that is backwards compatible with the 360. In order for backwards compatibility to work on the 360, it requires an official MS brand 360 hard drive.
