Why is my Xbox seriesx not upgrading some of mine games

You only get upgrades for games that supports Smart Delivery. Most other games have the upgraded optimized versions for the Series X|S consoles but you have to pay for them.

Keep in mind and optimized games MUST Be Stored on internal.memory or the storage card

External hdds will not work for patched or optimized games

These advisors need to read up on how optimized games play or don't play on a SeriesX/S.

Games that are optimized for the SeriesX/S CANNOT be played from an external HDD and that'll be why you can't load those game.

With the games telling you that an upgrade is available that'll be why you can't load them unless you install them on the internal storage.

At least you gave the right advice about the optimised/upgraded SeriesX/S games only be played from the internal storage or an expansion card as there's been some bad advice given by some that you can play optimised/upgraded games from an external hdd/ssd.

So I'd have to purchase the game now on disc to play it on my seriesX?

Is it not available from the store if I use a 360?

I know some games don't show on seriesX but do on 360 store.
