Hi, I don't think anyone in the forums will be able to answer the question, which is why I think it's best to contact Xbox Support (via phone), as I've mentioned in your thread mentioned here:

they should not do that, cosmetic damage does not negate the fact there is a fan issue and is not the cause of the fan issue, which country are you in.

I am in the UK and regardless of the cosmetic condition, if a unit is under warranty and the fault is not due to the cosmetic damage they are compelled by law to still fix the unit, they are probably having a hissy fit as they would have sent you a refurb and then fixed that one later and then sent that to another customer, which is bad practice.

I would fight it.
