The system always check first your account entitlements before game sharing. If he has subscription on his account, setting his Xbox as your home console won't affect his game play even if you don't have a subscription.

the only way he could have took it is if you shared accounts to gameshare or left your account on his xbox without a passcode, you are responsible for what ever happens on the account.

I think you might be gamesharing with someone with Xbox Live Ultimate which makes it so you can play without an active gold membership.
