I was recetly banned from voice communication for retailiating to someone that was being extremely aggressive and using fowl language. How come xbox decided to ban me and not the persons telling us to go kill ourselves? Seems a little messed up. If someone
from microsoft could respond that would be much appreciated.

You can view your ban by logging in at enforcement.xbox.com and from there file a case review if the ban is eligible for one.

Depends on the game.Some games are quiet.A lot of people just stick to party chat because they don't want to hear little kids screaming down their mics etc.

Even if someone does get reported they will only be suspended if they have done something to violate the ToU/CoC.

you must be rated e for everyone regardless of console or services and yes its a universal code of conduct

Sometimes our reactions are what we get punished for more than the person committing the initial crime.

If someones being aggressive or rude in chat, report and block them. Then its out of your hands and in enforcement's hands to decide whether or not a ban is needed.
