“Once the Xbox One and Xbox 360 system updates become available in June, Xbox Live Gold members who purchased a paid membership before that day can cancel and receive a pro-rata refund of any unused remaining days between the date of cancellation and
the date their paid Gold membership ends,” reads the updated FAQ.

“Cancellation and pro-rata refund requests require six to eight weeks for processing. Free or trial Gold memberships are not eligible for a refund.”

For future reference, Games that require Xbox live will tell you in the overview, "REQUIRES XBOX LIVE GOLD, SOLD SEPARATELY."

I believe they will only refund gold if it is in the first 30 days of the subscription do there are no guarantees.

You can request cancellation of your current GOLD subscription and refund of the unused balance with token codes. You must specifically request/demand this. Only at this point will the permanent payment instrument (paypal, credit cards, etc) be disassociated
with your account. It will still remain associated with your billing account but will not be / can not be used for subscription or content purchases. Be mindful of this detail however -- that a voluntary cancellation without ensuring you are to receive a
refund of the balance via token codes -- will forfeit your remaining balance. Do not get off the phone with support until the token codes are in your hands; request a supervisor if necessary to complete the process.

Sorry to hear this has happened. I am pretty sure it is available under Games with Gold until the 15/01/2020.

I would suggest you check out the Request an Xbox digital product refund page and submit a refund
request citing this is a Games with Gold game.
