sign out of xbox live account

i've tried signing in with the 2nd controller once i'm in the 360 emulator but it will only allow me to sign in as a guest Xbox live account. If i try signing under my Xbox live account, it signs out of xbox live completely.

Thanks for reaching out here in Xbox Forums. I understand there is an issue with removing an account from the Xbox 360. I recommend to try the following article:

Try this out and let us know the results.

You don't need his password to sign out of his account. Just hold the Xbox button to open the guide and then use the X to sign out. Then you can add your own account.

As far as backing anything up, you can either use the cloud (which requires gold on the 360) to save game saves or use an external storage device. Account information and game purchases are stored on the Xbox servers so those can be redownloaded.

So provided your games installed are linked to your gamertag and not the one you want to remove, if you follow the bottom half of this guide linked...

Add/Remove Account and Gamertag from Xbox 360

...you wont need the original owners details to remove that account. If any of the game are linked to the original owners account (digital titles mainly and some DLCs perhaps, you will lose access to these ones following the removal.

You should already be able to sign in with your own gamertag by downloading your profile to the console, also detailed at the guide linked above. Also, of you encounter more problems removing it, it may be the original account is trying to auto sign in??
if so then have a read here to toggle that setting...

Although disabling auto sign in does require you to be signed into Xbox Live already.

Just to clarify, are you unable to sign out of his account by using the guide button and fitting the
X button? After doing so, you should be able to sign in on your own profile. To remove a profile:

1. Go to settings and select System.
2. Select Storage.
3. Select Profiles
4. Select the profile you wish to delete
5. Select Delete
6. Select one of the following:

• Delete Profile Only – This deletes the Xbox profile but leaves saved games and achievements.
• Delete Profile and Items – This deletes the profile and the associated saved games and achievements.
