Now, if the name is in use, unfortunately there is no way to use it.

Simply logging into their account and/or email periodically is enough to make it stay "active" as well.

There is no way to 100% know for sure if an account is truely inactive since they are used for more than just Xbox live.

As of 2018 (i believe) if a user doesn't sign into their xbox account for 5 years then their gamertag can be freed up. If they don't sign into the Microsoft email associated with their xbox account for 2 years then their gamertag can be freed up.

So even if they person doesnt use the actual Xbox account itself, if they simply login to the associated Microsoft account email at least once every two years then that would be enough to consider their account "active" and as such their gamertag would never be freed up in those circumstances.

If the gamer tag is in use, you cannot request it be freed up. People have microsoft accounts they use for many things, and all MS accounts have tags attached.
