If your son’s Microsoft account is currently linked to a family group managed by an unused email address, only the current family organizer can remove the child’s account or transfer organizer rights. Unfortunately, Microsoft does not allow a family organizer to be removed or changed by anyone else for security reasons.

Sign into the Family account with your account and remove the account of your son, and then send an invitation as a child account to your sons email. And he can join the FAMILY as a child.

If that's the case, your account can be a child account in a family account in which your mother's email is the parent account. If that so, she will need to remove you from the family account.
