Refund request for item purchased without knowing it was included with Gamepass

I recently purchased the Rainbow 6 bundle for the operators but was not aware that it was included with my gamepass subscription. I only found out after the 14 day refund policy deadline had expired (a friend I was playing with told me). There was no warning to say that the item I was about to purchase was included with my gamepass subscription. I have been declined a refund for this but I find this unfair. How can I pursue this request further? Subsequent emails to the customer service representative were closed with no reply.

Hello, sorry to say I dont think its any way around this. The 14 day period has passed so a refund would not be granted. All I can say is in the future make sure you check and see if the game you want to buy is avail through any other subscriptions that you have. The only thing XBox will do is tell you if the game you have is already owned. I thought it also tell you if its cheaper due to a game pass subscription. Just have to be careful with purchases in the future.

The marketplace has a no refund policy. This, on top of the fact that you used a digital download code and didn't actually purchase the item from the Store compounds the issue.

I don't believe you're going to see a refund for an item that was downloaded from a code. Even if the code came with the console you purchased.

However, any billing inquiries (including refund requests) must be dealt with through phone support.

Unfortunately there is not a way to swap a purchase without refunding the original purchase and having you purchase the correct item. The only way to do so would be to go through the refund request form. Once you submit a request and they either approve
or deny the request, you can email them back to give them more explanation, but since the original purchase was done in September it's most likely no longer possible to have anything done.

If you do not see the item you request a refund for listed, via the link that Darkist1 provided above, that usually means that the item doesn't qualify as a refundable purchase.
