Refund on unplayable game?

Pre Ordered the Mighty Number 9. Got to finally play it on the weekend only to find that the game itself is so bad, it is borderline unplayable. It constantly freezes my console, forcing me to restart the console, when I get to play it, it pixelates, has
unresponsive to controls and looks like a game made for an android phone? I spoke to support and requested a refund but unable to provide one as the game downloaded and launched fine. MS are not responsible for in game quality.

I emailed the developers and tried to get a response from them, and nothing as of yet. This game simply does not work. I did remove it and re download it, powered down console and tested still not working. According to the ACCC, if goods delivered are of
not acceptable quality, do not work, have either a minor fault or major fault, I am entitled to a refund. MS cannot say no refunds on a game that simply wont work, $30 for a faulty, poor quality game is not right or fair for the end consumer to have to put
up with.

Is there anywhere else to get my money back on this useless game on my console?

( wont even mention that the characters are nothing like the screenshots shown during development. Looks like they are now badly cut and pasted into the game with a shimmer around their outline.)

Anyone ever get a refund from xbox Live?

If you get a refund from Microsoft on a digital purchase you lose the license for the game and it become unplayable.

The game will remain installed on your system until you uninstall it yourself.

Unfortunately refunds are not something we on the forums are able to assist with. The only people who would be able to provide you with one would be Support - I would suggest Phone Support over Chat Support. You can reach them here:

The terms of each purchase do state no refunds, however, which is what you have run into, so their decision to provide a refund or not would be their discretion.
