Refund on defective game

I recently purchased Minecraft windows 10 edition and was hyped to play it. Only to be stopped by it not loading pasy phe startup screen before glitching out and ultimately crashing. I have been able to play the game for maybe an hour which was super
laggy and not all the textures loaded correctly. Now im unable to even play the game as it coninues crashing. I talked to support for an hour trouble shooting the problem with no luck. Also it is not an issue related to my pc as i have a 2080 and a r7 3700x.
I contacted customer support submitted a request only to get denied. I resubmitted one sighting that "We provide Digital Game Product refunds as part of a consistent and reliable buying experience. Most
people pursuing a refund just want to solve a problem" and also stated that i had not had the game for longer than 2 weeks as that was in the requirements. Also i didn't download any third party software either. But when i submitted my rebuttal the support
person said' " we may not disclose any further information but we cannot give you a refund because you consumed the game". I am unable to play the game and even the tech support had no idea what was wrong with the game. So what im asking is there any way
to repeal a rejection or is there anything else i can do to get my 30 dollars back?

you should be entitled to a refund from the retailer as the unit is defective, not just a repair job

anything you purchased for it however would not be entitled to be refunded as those are not defective

Yes that seems to be the case, the only refunds they give are for defective merchandise. I couldn't get xbox live coop to work at all. Does that constitute a broken game tho?

What would help is if you took down the broken game. You agree that it exists as you've said but are selling it as defective. On top of that not giving refunds. How do we troubleshoot that?

I see. It is quite possible that there is a defect in the data on the disc and it is showing this message. I would try to exchange the disc or ask for a refund and buy the digital version of the game from the Xbox store.

Obviously there is no resolution for this so the console and games are going back for a refund, (thankfully consumer law in NZ allows for the return of defective equipment, however the hours I have spent trying to find a fix are just wasted).

Will put refund money on a PS4 I reckon. Thanks for nothing.
