Question about modded consoles for sale

I have no idea if this is the right forum for this post or even what a better one would be so feel free to redirect me.

It has come to my attention that a local person is advertising modded original Xbox consoles that are 'pre-loaded with 720' games.

I'm not happy about this as I'm pretty sure it is illegal in some way. The information I've found online is often conflicting. Some say it's all illegal while others say it's only illegal if there are games on it and a few said none of it was illegal. I
also tried to figure out a way to ask microsoft about this directly but have only hit dead ends. If anyone, from microsoft or not, could help me figure out if its illegal and if so, how to go about reporting this. I have a screen shot of the facebook post
but I wont show it on the forum unless asked to by microsoft.

Any input is welcome.

To answer your question succinctly, it is very illegal end of discussion. Unless all the games are open source, you are buying a big bundle of copyright infringement. Don't worry too much about getting this guy busted, just don't get yourself in trouble.
Getting caught probably won't send you to prison, but it will cost you.

Hey Artaxia! Would just like to chime in and confirm what the Ambassadors here have said. It is against the TOU to use modded controllers, and this can therefore result in a ban from the service. We advise you play fair and follow the TOU!

See I think using one when playing a single player game would be ok, to use it online in multiplayer, would give the user a unfair advantage. More along the lines of the lag switches that some use.

Yes, this is illegal and we do not encourage it at all. People found to be using such mods can be banned for life. There are some controllers designed for shooter games which may allow you to shoot a little faster but these are sold from endorsed stores
and sellers. I do not advise buying anything from the site you mentioned.
