Pointless restriction on ability to change your gamer picture

So recently I have been looking to change my gamerpicture and after several tries found that no matter what I tried to upload, it just would not change. After getting in contact with Microsoft support I found out that there is a 90 day restriction on changing
your gamerpic upon finishing ANY form of enforcement action. Now I may disagree with the opinions of the enforcement teams on what is considered to be a violation of the terms and conditions but I accepted the punishment regardless. I feel like that should
be the end of it surely? Why enforce something as arbitrary as that for 90 days after? Thoughts and opinions would be appreciated and if theres any members of the enforcement team reading this can we please get this changed as it is simply ridiculous, I can
change my gamertag, Bio, avatar but not have a custom gamerpicture? The punishment should end when the enforcement action does.

It doesn't seem like there's a way to change your gamer picture on Windows 8 just yet (even as of Windows 8.1).

It also doesn't seem like you have the ability to change your gamer picture on the Xbox.com Avatar Editor unless you've first downloaded your profile to a Xbox 360 console at least once.

 

how do i changing settings so I can add a custom profile picture?

On my xbox one s I am unable to change my profile picture to 'custom' due to 'privacy settings or age restriction'. How can i change this?
