Please go to https://support.xbox.com/contact-us and sign into your account/create a new account.

Kindly select Contact us. There will be 2-3 questions in the prompt, you will need to select your answer from the dropdown. Press Next after.

You will be offered with Support Options to get assistance and you may select Call if it is available.

It says 360 only, but it may lock him out of the One.

Just to confirm: did you change your password? Last time I tried this, that on its own was enough to force a One to ask for the new password the next time I signed in. That should be enough to regain access yourself, at which point you may be able to change
your Home Xbox to your own.

Now, if it is not, you should contact Phone Support and get them to look into this:

support.xbox.com/contact-us

If you can verify to them account ownership and such they may be able to grant you permission to change Home Xbox, otherwise you will need to wait three months during which time you will need to always be connected to Live in order to play downloaded games.

There's something bigger going on with the recent rash of XBL hacks. I'm a freelance writer (mostly covering tech and gaming) and I come from a background in IT. I know how to make a secure password, I know how to avoid phishing scams, and I keep different
passwords for my various accounts. I was hacked, and the hacker used my account to buy in game currency for FIFA, which (presumably) was then used to purchase in game content that was traded back to their original account.

In other words, don't blame the victim for getting hacked - it's not necessarily their fault. I took every possible precaution, and was still a victim of this recent rash of hacking.

I'm very sorry to hear that your account has been hacked. Below I will leave you some instructions!

Update your security program: Make sure your computer's security program is up to date, then run a scan.
Account recovery: Follow the steps to recover your account. You will be asked a few questions to confirm that the account is yours.
Change your password: When prompted, change your password. Choose one that is safe and that you have not previously used on this account.
If the hacked account is from Google; You can follow the specific steps provided by this company to recover the email. If the account is from another provider, I would recommend you search their official website or contact their customer support for help.
