locked out of xbox account

ok here we go

a number of years ago i had issues with my xbox 360 over heating i had the serial number wrote down so when i received my repaid console i noticed the serial number was different after a number of emails i resolved the issues and got an apology from Microsoft
and some free games viva pinata perfect dark zero

later that year my xbox was stolen along with my xbox account *** Die E-Mail-Adresse wurde aus Datenschutzgründen entfernt. ***..uk

for a number of years i lived without a console as i was unable to access my account i have used all the recovery tools via email answered all the questions but i think the thief has changed all these as i am unable to access the account and it is currently
blocked

clearly looking at my new email address and postal address it is easy to see this account belongs to me as i am the only poor sod that is trying to access it and there is nobody complaining that the account is blocked

as i do not have the serial number for the console due to the mix up from microsoft the support team suggested that i try on here to get help from the escalation team as i no longer have access to the console as it was stolen i do however still have the same
ip address the console would have been connected to

i just was access to my account so i can play the games i paid and downlaoded for my xbox 360 these include gta ballad of gay tony gta lost and dammed and shivering islands for oblivion the elder scrolls iv and get access to my 120K plus rep points

Long story short, my dads email was the email linked to the account for recovery purposes but because he passed away recently I can't use his email to recovery my account as I don't know the password into it, instead I tried to use my own phone number but
that takes 30 days to come into effect, so now I'm locked out of my account with no way of getting back in.

There is no "escalation team" here. This is a public community forum used mainly by other gamers such as yourself. Account recoveries cannot be done on the forums. Only phone support are the ones who can assist with account recoveries. You will need to
continue working with them.

Have you tried removing your XBL profile from your console and then adding it back using only the new account credentials? If you haven't then that might help you out however I'd double check my Microsoft Account logon & email details on the web site first to ensure there is no sign of your old email address associated with your account.

Sadly, if you can't provide the necessary information, it won't be possible to recover the account. Microsoft takes your security very seriously, and to protect customer privacy we can only help customers verify their account ownership through the online password recovery process. If you can't access your account verification methods, you won't be able to recover your account, even if you fill out a form. This is a sad situation, but there is nothing to be done.

So the hundreds of dollars that I’ve spent on games and DLC over the last 10 years, all the progress I’ve made in these games is just gone? And there’s no reason given?

Same response as last time, told that they can’t help me and I have to reset my password. In order to reset my password I have to verify my identity which I can’t do as I have lost access to my backup email that I made over 10 years ago.

Im so sorry that you’re experiencing this. You have mentioned that you tried contacting support. I would recommend either contacting Xbox support again or when you click on the link there is a search bar where you can search up the issues you are experiencing. Let me know if this helps!

Have tried this, it all loops back to either me needing to verify my account (which I can’t do because I’ve lost access to the email I set as a secondary address) or to a message saying they can’t help me.

Did you get an email of an enforcement action on your account? If you didn't then that's not it. Also I haven't seen an enforcement action that locks account, you can still sign in even with a permanent ban.
