you can't unplug it. so its not off Like standby mode in a tv, its still plugged in. and if you press your remote when in standby?

If kinect and the controller interact with infra red when on ,why wouldn't you just sync the controller through kinect when off,

It would make more sense as kinect is a controller too, I think all the tech to sync the controller is in kinect. The xbox then only has one controller input to deal with, and it all comes from kinect, even when kinect is in standby.

There has to be a legitimate reason why you can't unplug kinect, MS not just being funny

_^^ If your Kinect is able to control your TV, then the answer is yes. The remote controls all devices via the Kinect.

That's just used to sync the controller. Once synced, the controller should, technically, work just fine without the Kinect. So, basically, this doesn't prove that the system will not function without the Kinect.

Once your controllers are synced, I see no reason why the Kinect can't be unplugged.
