Issues with Elite 2 controller

I recently submitted an order for a new xbox elite 2 controller as the original had left warranty and was having massive button registration issues. The last #s of the serial for this controller is 6146. I placed an order for a brand new controller and was shipped a new controller with last #s 2144. I have had this controller for under 2 weeks with mild use and it is already having issues with buttons not registering. My issues are two fold.

Issue 1: The order email from Microsoft lists the serial number of the old controller, not the new controller that was paid for as part of that order

Issues 2: The new controller was not tied to my live.com account even though I had ordered it directly from that account. I manually attached it to my account but the warranty end date is the exact same date as the old non-functional controller. So even though this controller is brand new Microsoft is telling me that it is out of warranty.

Because of the issues above I have been unable to launch a repair ticket without microsoft attempting to charge me for the repair.
