Is there any chance of recovering a Minecraft account from a deleted Microsoft account?

I couldn't say specifically what it would request. It would be between them and Xbox for the time being while they build up the case. If you go that route they'd be able to give you more information on what to expect

Could a subpoena recover the account though, or just the data?n

As their hands seem to be tied your best bet now would be to involve your local or state authorities on this. They can supply a subpoena to Xbox regarding the account information in the hopes of getting it back for you.

In the meantime, if you have any payment methods associated with your account I'd recommend notifying your bank/credit card company
