While games may have ratings like M for mature, or T for teen those only restrict who can purchase them, not play them. Live too has a rating, it's E for everyone,

You don't have a right to say who can play who can't cause we all paid deep outta pocket for the system and game and etc.

Actually Microsoft, or any service provider, does have the right when using their service. The
U.S. Constitution covers only what the U.S. Government can and cannot do.

When signing up for Live, users agree to follow the
Terms of Use and
Code of Conduct. Microsoft has even noted the consequences of not following the rules listed in them as well.

Tools are been provided to mute, block and report users who break the code of conduct on Live. Most microphones even come with a mute button.

It's up to the user to follow the rules as well as use the tools provided.

As for the "Back in the day... what was said didn't matter" comment, every service provider has had rules on what can and cannot be done when using their service since the days of dial-up. The difference these days is that companies are enforcing the rules
that have always been there.
