I can still play my refunded game

It can be considered marketplace theft if you refund a game and then continue to play it without purchasing it again (unless it's on Game Pass or something and you're playing it that way).

Have you received the payment back or is it just approved still? I can't see why you would get banned if Xbox has not stopped giving you access. I would suggest uninstalling it though and not playing it.
