How to unlock it I purchased an Xbox one from a yard sale but it has a passcode set on it...

There should be am option to skip sign in and then you would go to Settings > Account > Remove Accounts > Select the account you want to remove > Remove to remove the previous owner's account. The code would be to sign into their acocunt, not the console.

how is it ms's fault you didn't passcode your profile?

Careful..that almost sounds like one of MS elitist comments .. and I very rarely sell games at yard sales except for a annual fund raising event...I do buy a few though from yard sales...you would be surprised the rare gems you can find that people don't
realize they have

On the Xbox 360 Dashboard go to Settings>Account>>Your Information>Xbox LIVE Passcode. Set your passcode. No one will be able to connect to Xbox LIVE without your consent, therefore he will not be able to purchase any content without you knowing.
