You can go into settings from your xbox console or at xbox.com

is all your privacy settings set to open?

Go to settings on your Xbox with your son's account.

You should see the settings for accounts, and should view privacy.

depending on how its set as it could determine why your son shouldn't be able to add his brother on Xbox.

Open "Xbox Live Privacy" and customize the setting there.

Also, is your son's account a child account? Here's how to tweek the privacy settings:

• Check that your privacy settings allow communication with everyone. Press the Xbox button to open the guide, select System > Settings > Account > Privacy & online safety > Xbox Live privacy >View details & customize > Communication
  & multiplayer, then make your changes.
