This may mean that you're signed in under the wrong Microsoft account where the games were not purchased.

Please sign in to https://account.microsoft.com/billing/orders and check if you can see the game transactions from there. If not, please check all Microsoft accounts that you own. We need to locate the game transactions in that way we can confirm that you're using the correct account.

He is playing on the new Xbox on his account not set to home. I'm playing on the old xbox on my account set to home. Right now the only way it seems to work is with him playing on my account on the new xbox and me playing his account
on the old one. All games have been purchased on my account.

I transferred all my licenses about a month before my old 360 broke, now i have bought a new one but the boy cant play my games on his profile for the next 3 months

Then you need to set whichever console he is playing on as your Home console.
