Comms ban is not from a profile picture. Its more likely from other people in games that you play

I’d like to upload a new profile pic but I’m not sure if middle fingers are allowed in them, would I get banned for this?

If you profile picture breaks the terms of Service in some way, then, yes, you could get banned for it. The Middle Finger (assuming it is being used in the way that would be rude), whilst commonplace, is still a rude/Obscene gesture...as Xbox live is for Everyone, all content needs to be as such.

Someone posted on here yesterday where they'd been comm banned for 24 hours for an inappropriate GT picture and said picture was also removed

I did I have a 4 day comm ban because of that picture

I was comm banned a around a week before all this for my profile picture. But I can't find any other reason for why I was banned. The worst thing I can think of that I did on Xbox recently was that I messaged another person the strait faced emoji because I lost to him paint mashing on 2k, but I know it could not have been that because when I went to check why I was banned (before it was telling me "Sorry, we can't get notifications right now. Try again later") it said I was banned for my profile picture, although I only changed it once since I was comm banned and it was to a Russell Westbrook selfie with the caption "Selfie Sunday". Overall, that was really all of the activity on my account so unless any of that goes against TOS, I don't think I deserve to be permanently banned.
