Games with Gold - Gears of War 3 Problem on xbox.com NZ Please help

I cannot purchase the games with gold Gears of war promotion

I have purchase Gears 2 and Judgement without an issue. but gears 3 throws up this

"Sorry

Is this your first purchase? To ensure it is compatible, please sign in to Xbox Live using your console and try again."

Unlike anything else I purchase this game asks me to login again.. which is Odd!!
I am logged in. (logged and and out many times.)
I have tried on many PC's.
I do not have a 360 anymore but getting ready for Backwards compatibility.
I have been through Microsoft support and still no way to claim my Games with Gold Gears 3
Hope someone can help

Hi There,

I'm trying to purchase this fortnights Xbox 360 Games with Gold Army of TWO™ The Devil’s Cartel game but get the nondescript message:

"Sorry, Your purchase cannot be completed at this time. Please try again."

I successfully purchased the other game currently free on gold no problem.

Two weeks ago I had exactly the same problem with Gears of War.

Please help!

Gears of War Series aren't actually available for Games with Gold

The Games with Gold promotion for April (Games with Gold | Xbox Live) has four Gears of War titles listed:

Gears of War: Judgement

Gears of War 3

Gears of War 2

Gears of War

Of those, only Judgement is actually available for complimentary download. The others are not free or have no download at all (Gears of War 3).

Can they please be made available as advertised?

Hey, guys! In order to get this game, you will need to purchase it through a 360. This error normally appears if you haven't made a Games with Gold purchase on a console, and the only way you will be able to get it is by attempting the purchase on the console.
We generally suggest you use a friend's 360 if you do not own one yourself.

If you are still getting this error on the console, please let us know! We'll look into it further from there.
