Nope, right now the gamertag system works like this:
If it's available you can use it. And unless the gamertag is unused you can pick that specific gamertag
If it's not available you may need to pick a different one

It might be that since there is a Muppet character with that name, and "Fozzie Bear" is a trademark by Henson Associates, that Microsoft is forced to block Gamertags that relate to trademark names.

If the system tells you that a name is not allowed, you have no choice but to choose a different one.

You cannot use this gamertag as it is used on another Microsoft Account required service.

You can claim trademark as much as you please, but you're never going to gain access to that gamertag.

You can't trademark an xbox live gamertag.

It's taken,there's nothing you can do.Moderators are just regular xbox users like you & me & cannot help you.

As i've said,you cannot request that a gamertag be freed up,you will not get that gamertag unless it's user changes it to something else.
