Deliberate account password change

Is a simple way to just report the email so the entire email gets deactivated.

As the other person has all access to the account, you're options are recovering the account as you are unable to access the email account attached to it, going through the

account compromised steps, or abandoning the account. These are the options all users have when their account is compromised.

For an account to be deactivated, a user either has to sign into the account and close it, or the account has to not sign into any services, or the email not be signed into for a specific amount of time.

He stated the other person owns the email account which therefore he owns the xbox account too, trying to gain access is fraud.

unfortunately you will need to cancel the card associated to the xbox live account that is also the email account of the owner and start fresh.

Microsoft will not assist unless the actual account holder calls in.

you say its your xbox account but his email, therefore legally its his account, Microsoft will not assist you in gaining access to that account as your are not the owner, you will have to ask the bank to cancel or block any payments onto the account that
is technically not yours.

Xbox live accounts are linked to the email account, they are one, whoever owns the email account owns the xbox account too.

The only thing i can think is to follow the
Help with the Microsoft account recovery form and see if that works. Ultimately the process wont be simple as otherwise every account could be open for the taking.

click on the password recovery option and follow the steps, the support team cannot help you unless you answer the correct access questions
