Custom image upload to activity feed' question.

I've noticed that a lot of people people have been banned and or suspended for uploading custom videos and images on Windows 10 through the Xbox Beta App to Xbox Live. I have also noticed that a lot of people people get away with uploading a lot of copyrighted
images and videos, that which includes partial nudity, nudity (with or without underwear and bra, it still qualifies as such.), and images that almost appear to be a type of pornography known as
[Mod Removed].

So, why the inconsistencies by the Xbox Live Enforcement Team? I report these videos and images and they are never taken down. Either the Enforcement Team needs more employees or they need to work longer hours in order to keep everything in check. Anyway,
i would like to upload a couple of images of my own to my activity feed. No, the images are not stolen content nor copyright material. With all of this being said, i will post an image here for everyone to see.

Image one; A beautiful photograph that i took on Forza Horizon 4. I downloaded the image via the Xbox App and edited the colour pallet on Adobe Lightroom CC with the purpose of it being so that my photo looks more vibrant. I also used a custom filter (made
by me) in order to make the image pop and include more depth. Anyway, am i eligible for Enforcement action being taken against me for uploading my photography (Digital photos i.e. from my racing games, and real life automotive photography taken by me.) I ask
so that i know wether or not to risk it.

It sort of helps but I'm still uncertain because it doesn't reference to anyone uploading images through the Xbox Beta App on Windows 10, i.e. a custom image upload to your activity feed.

We understand the concern towards avoiding an enforcement action. We appreciate that you are checking to see what is and is not allowed. Regarding what type of images are best to avoid, check the following:

Images intended to harm or harass another person
Images that depict nudity or are sexual in nature
References to illegal drugs
Depictions of real-life violence or excessive violence/gore
Images containing personal information
References to hate groups, terrorist organizations, or notorious figures
Inflammatory images directed towards specific demographic groups

In my personal opinion, that image seems like it would be fine considering it does not have a game logo but you may want to try covering the name of the car. You can also try editing the image to distort it a little. Otherwise, I would post it and see what
happens honestly.

What's your opinion on this matter? Would you go for it? It's not stolen nor copyright material. I'd like to assume that they have a way to detect wether it is or isn't but i'm not entirely sure.

Thanks for replying. To add to what XBF Crystal has already said in reference to the Custom Image information from the Enforcement page, it does stipulate on the page itself that "Whatever image you choose, keep in mind that all images have to
follow the guidelines in the Code of Conduct. " And in the contents of the COC, it does say:

Don’t pirate or use another's content without permission. For example, don't:
Use another's intellectual property without permission (e.g., copyrights, trade secrets)

In this case, to keep yourself safe from an Enforcement action, you should use your best judgement.
