Concurrent controller repair

I originally bought a 2nd hand series 1 elite controller back in October 2019 that was still under warrenty as it had a burnout rumble motor I did a service request got what I was told to believe was a brand new replacement.

Fast forwarding to now after 6 months of light use I noticed one of the triggers was making a cracking/knocking noise on further inspection BOTH triggers have a gigantic crack just inside the casing down on either side basically on the verge of breaking
off.

I go to fill out a service form and it shows me that it isnt covered under warrenty even though I apparently recieved a brand new replacement less then 6 months ago.

I've read the 90 day repair guarentee but this isnt a repair or a refurbishment it's a brand new device that microsoft provided. Why am I not covered when this device is less then 6 months old? Seems like I've wasted my money been given a replacement thst
wasnt up to scratch and just been told "tough luck"

UPDATE:

I've attempted to contact today apparently a warranty issue isnt a good enough reason to speak to a agent over the phone or even webchat. Short of lying just get through to someone I dont know what I can do. This is getting ridiculous

Edit: even the call back feature is refusing to work...........

As of yet no. Stopped when I got as far as the no warrenty warning just thought I'd post here as I called originally on the first service request and they put roadblock after roadblock.

For it to be the update the issue needs to occur on other users, and it still would have occurred concurrently on both controllers at the same time. As a player I can only instruct, but if you believe that the update is the problem, the only option is to wait for a new update to fix it.

Cause they chose to extradite anyone and anything that is not concurrent with their beliefs.
