    Chat Ban Upheld XMAS Eve HELP


    I was chat banned for two weeks on Sunday because I was playing an online game and the opponent decided to force pause the game repeatedly and send me trash talk messages. Eventually it got to me and I retaliated because I’m sitting there staring at
    a pause screen with trash talk messages being sent. Well the person reports me and I get a 14 day chat ban.

    So I did a case review ASAP. Argued that I was harassed first, the other person was trashing me, so I retaliated to defend myself and I shouldn’t be banned for two weeks because I didn’t start it. This is how the national law works. If someone punches
    you first, you can defend yourself. Apparently Xbox views it that anyone can harass me and thats okay because...

    Well, Christmas Eve at literally like 10pm I find my claim denied, which tells me they literally did nothing to investigate the situation. I have no other way to contact them and now can’t use my full account all holiday.

    I have been an xbox member for 8 years but im about ready to sell everything and move to playstation like everyone else now. Ive never been treated this poorly by a company and i will file a lawsuit if i have to.

    I'd suggest you review the
    Code of Conduct    , you violated the terms of service so you have no grounds for any legal action. You should also note that PS has comm bands for this kind of behavior as well.
    Thr only difference is PSN doesn't actually do Com bans. They would suspend the entire account in these types of cases. Not just communications.

    Well if you decide to switch, keep in mind that PS has similar rules only they don't have a review process on suspensions at all.

    You were suspended because you violated the code of conduct, not because you were harrassed.

    You agreed to the Code of Conduct when you signed up for an account.

    No one in the forums can help when it comes to suspensions or bans as it is all in the hands of the Enforcement team.

    In regards to your harassment you received from another player. I would suggest you report and block the player in the future, as the are provoking you to breach the code of conduct.

    Good luck with legal action. You agreed to abide by the code of conduct when you created your account. Don't forget to take a copy for your lawyer to read.

    Two wrongs don't make a right. Just because someone else started it, does not give you the right to retaliate in a way that violates the code of conduct.

    There is something i can do. Sue the company. Because i was harassed first, then i get banned because someone else started harassing me, and now my entire holiday is ruined because i cant use my account. Ive been an 8 year member. And the damages this
    ban is causing me over this holiday i will sue for. I know that this was not reviewed fully. Hence the decision on xmas eve.
