Can I get banned if I use xim on offline games?

We appreciate your interest in using XIM, keyboard and mouse on your Xbox console. Xbox supports the use of mouse and keyboard in some games and apps, but it doesn’t work for all content. However, we do not recommend or endorse the use of any third-party devices or adapters that may alter the original functionality of the controller or the console. Using such devices may violate the Xbox Live Code of Conduct and Terms of Use and may result in enforcement actions such as suspension or ban of your account, even if you use them on offline games. We highly suggest as well to check the game's policies and terms of service before using any third-party devices.

This is against the Terms of Service, you could get banned, I don't recommend you do it.

I know I’m console banned, at least for now because it says “this console has been banned from the xbox network”.

I said “I thought xbox had some software that could detect xims” because I don’t have a xim. I don’t use xim. I’ve never had a xim plugged into my xbox, I have a wire mic and wired speakers. That’s it. I’ve never had a xim, I just took a picture off google and made it my profile picture to get people angry.
