Can't see the "Claim digital license" option

When you buy a digital purchase (anywhere, not just Xbox), you're buying a license to use the content, not the content itself. So your access to that content is limited to how the service allows you to use the license.

When it comes to Xbox games, the system has to see that you have the license to play a game. Discs games make it easy because the license is on the disc. For digital games, you're given a console license and an account license. The console license allows you to access your content offline because the license is on the console. The account license allows you to play the games on any console, but if the console license is not on that console (basically your non-Home console) the system has to check the server to make sure you have a license. If it can't access the servers, it can't check for your license so it doesn't think you own the game.

I can't speak for Oddworld, but you won't see Scarface become BC anytime soon, if or when BC starts again.

Why?

Licenses. Scarface is based on the film license of the same name. The licenses of which the developer/publisher no longer holds. A common issue with games from movie licenses. It was removed as a digital PC purchase for the same reason.

I can't transfer the digital license of one version to other version?

You would have to purchase the game digitally in order to play it on a Series S. The license to play the game is on the disc. Without being able to rea the disc, the console won't see that you have a license to play it. If you purchase it digitally, you'll have a digital license to be able to play without the disc.

It's not as simple as you might think. Games have licenses, these licenses apply to in-game cars, music, even real racing venue's. If the publisher (in this case, Microsoft), doesn't renew these licenses then the game can't be sold digitally. If it can't
be sold digitally, then it is unlikely to be made backwards compatible.

The licenses for all of the Project Gotham games have expired and the game has not been available for some years on the Xbox Marketplace.

I highly doubt this will become BC. Sorry.
