Xbox Series X Suspension/Ban

Good day all,

Yesterday, October 27th 2022, at approximately 3pm CDT my recently bought (In July of 2022) which was brand new through Best Buy that was direct from Microsoft was banned. I have a given banned time window in which I can't interact at all with xbox live on it until my ban window is released which I have been given a time frame of. My question to all is how does a console that was bought brand new get a long term suspension out of the blue without any reason? Before I received the ban I was watching movies on Disney plus that was download on my xbox. Watching Disney plus, HBO Max Hulu, Vudu and Netflix is all I have been using my xbox for in the entire month of October. I still have all my warranties for my console and it has NEVER been opened by myself nor anyone else, thus I shouldn't receive a ban/suspension for any hardwear manipulations as the console has never been opened. Furthermore I have read forms and mayb people had similar problems back in 2009 right before the release of MW2 and now the day befoer MW2 is released I've gotten a console suspension. I've received no emails no nothing and the only information I got is the little paragraph information on my xbox everytime I boot it up. I have 2 accounts on my xbox and neither have received any ban/suspension since before I got my new console and that was just a message suspension for cursing through messages. How ever that was months before I bought this console.

Here are the reasons stated by Microsoft on why console bans/suspensions happen: Xbox console tampering, such as physically opening an Xbox console and modifying the hardware to play illegitimate or unauthorized software. Online fraud, such as phishing, account theft, or other attempts to defraud Microsoft or other players.

If my console has never been opened by anyone that means I wasn't (or should I say shouldn't have been) banned/suspended for Xbox console tampering (i.e physically opening an Xbox console and modifying the hardware to play illegitimate or unauthorized software) In addition as I have previously stated before about my accounts I haven't received any suspensions in a while and they both are actively up and running. I can use the xbox app message people and join parties just can't use my almost 600 xbox. Thus if my accounts haven't received a suspension nor a ban it completely negates the second reasoning they are banned and that is for: Online fraud, such as phishing, account theft, or other attempts to defraud Microsoft or other players.

I've called Microsoft multiple times and they all have told me "sir you do not have a ban as there is no ban showed on your account" Yeah no duh because its a console ban. As stated by Microsoft they don't tell you why they ban/suspended your console and it can't be reversed and there is no possible way to contact the enforcement team to ask questions or anything except to submit a appeal form on your account. Oh WAIT I totally forgot you CAN'T as there is no notification or enforcement violation on my account only my brand new console.

I'm a computer science major currently enrolled in college and I've been with Microsoft, both using their computers and xboxs for over 10 years. I've never herd about this once I'm my life till now, I know loads of information about computers and technology in general. My father's best friend worked at IBM for many years in addition to his brother and his father(who worked on like the first computers at IBM and was with them for like 40 years) have never even experienced problems such as this. All three can build you a computer from sraps (which they have from their past jobs as they got parts from all different computers and what have you) and they can make them better than just about any regular computer you can buy on the market but it looks very very ugly.

He currently works at Dell and has extensive video gaming knowledge and experience as he also currently owns a Xbox Series X. He know everything about xbox box's basically and has really herd of this especially outside of physically opening an Xbox console and modifying the hardware to play illegitimate or unauthorized software.

With all my experience and knowledge I have gained and previously have this to me feels very sketchy and border line illegal in the sense that you are stealing money from me as I am currently paying for xbox live which I physically can't use due to my console being banned and I have no other consoles to use. Furthermore, if you think of this in a reworld legal stand point, you can't be arrested, convicted or prosecuted for ANYTHING unless you're previously told what you are being charged with. When you are being arrested they tell you. John/Jane Doe you are under arrest (let's say for argument sake) for the murder of John/Jane Joe. You have the right to remain silent... (the remainder of your miranda rights). They can't just arrest you and put you in jail and be like yeah you're being arrested and you're court date is ... and come your court date they say John/Jan Joe you are being givin a life sentence have a blessed life. NO they TELL you at some point what your CHARGES are.

Thus I feel I am obligated to know the reasoning behind why my console was banned just like if my Account were to be suspended. For instance when my account was suspended I was told by the enforcement team, you have been suspended for x amount of time from x day to x day for use of profanity which violates our terms and services and supplies the message you sent suck as [mod removed] you. Therefore I feel I should have the right to know why I am being wrongfully banned for something I literally haven't nor physically have done. And before you say well call the person/company you purchased your xbox from, I have and um its you guys as I bought the xbox on Best Buys website that was brand new direct from Microsoft. I have already spoken with like 10 Best Buy people and they have all said yes you may have purchased it from us however Microsoft should be who you contact as they are the manufacturer and who you purchased your xbox from as we get shipped x amount of brand new consoles from Microsoft and sell them to consumers such as my self. Therefore you're the only person/company I can go too and YOU CAN'T OR SIMPLY WON'T DO ANYTHING NOT EVEN SAY ANYTHING ABOUT IT. I urge , no sorry I more like DEMAND that I receive more information regarding this matter as I feel am obligated to know. Otherwise this stealing and border line definition of character as you are saying the console is banned/suspended for Xbox console tampering, such as physically opening an Xbox console and modifying the hardware to play illegitimate or unauthorized software. Online fraud, such as phishing, account theft, or other attempts to defraud Microsoft or other players. Which are all ILLEGAL!!!! And you are telling me I am doing ILLEGAL acts without even telling me what I have done ILLEGALL!!!!!

Frankly you are one of the biggest and richest companies in the world so you don't need to do this for the money. And second you're entire company and/or just the xbox side is so flawed in how the system is designed and run. Meaning banning/suspending console without telling the person why that is. To me you could just go and be like hey I'm gonna suspended you console for x amount of time as I can and I don't have to tell then why I can just do it and they can't appeal it. Which is [mod removed]. I demand an answer on this matter and over the weekend or on my free time I will be calling back again and I will climb the latter if I have to till I get to the very top and if I'm not given an answer one of a few things is going to happen. I'm going to use it for target practice, burn it, smash it, potentially file a law suit and/or go DIRECTLY to your competitor and buy a brand new ps 5, sell all my Microsoft accessories, and devices other than this xbox (as it is completely useless now as it can't do the one thing it's basically designed to do). And just straight go to PS 5 and spend thousands and thousands of dollars on them as this is complete and utter [mod removed].
