    A recently sent my xbox one s in for repair under warranty only for then to send it back saying that its void as its either been tampered or opened or serial number is invalid but a bought this console new from smyths store and when a call xbox regarding
    this was told sorry there is nothing they can do about this anyone any advice please

    Take it back to the store? If they sold you a dodgy unit, it's their responsiblity.

    Sorry to hear you are having problems, but the warranty clearly mentioned if you open the xbox or controller, you will void the warranty, if you have not opened and the seal is not broken, you can contact Xbox support.

    I'm afraid that nothing can be done. Off course, you can try support as suggested in the post above. Contact seller also to see if they tempered with the console. So sorry about your situation. But, fight on!
