I think that you have narrowed down the possible culprits well. Have you tried connecting the console to another network, cellphone hotspot maybe, to determine if the issue is the xbox or ISP?

If the console is able to get better upload speeds while in the other network then the issue could not be the console and would therefore have to be your ISP. The network I would not consider an issue since you have bypassed the router and the issue remains.
In addition, having this info would provide you a counter to when the ISP rep tells you that everything on their side is good to go and that the issue is elsewhere.

If the problem persists while the console is connected to the other network, then the issue is hardware related and you would have to send the console for repair. I am assuming that you have done a factory reset of the console so as to avoid any software
related issues.
