    I've already had a chat with XBox live support regarding this issue. But I'm wondering if anything can be done about it.

    I don't use a mic, and am dependent upon messaging to communicate with my friends. This hasn't been a problem; I either typed via a USB keyboard, or more recently just use Xbox messaging via my laptop. However in the past month I've had an increasing problem
    of messaging cutting out (they freeze you out for 24 h) once I reach their cap.

    I understand that the cap is in place to stop spam, but when I asked support what my cap was, the rep said it was based on an algorithm that depends upon (1) how many messages you send to friends, (2) how many messages you send to non-friends, and (3) how
    many messages you try to send to unique recipients (not sure exactly what that means). I asked if I send to non-friends if it negatively affects my cap number, and he guessed that it did.

    So since then I friended two people I occasionallly message, and have stopped messaging people not on my friends list. However, the problem has only gotten worse. At first, it seemed to only be a problem on the weekends (when I'm on the Xbox for more hours),
    but the last two nights I have been cut off as well.

    Is there any way around this? I'm only messaging a few people, who are all on my friends list.

    i am getting sick of getting banned for messaging my girlfriend on xbox

    There is definately a message cap in place and it seems like the OP is capable of sending messages but then gets stopped. Would seem to be the cap in place to me.

    However it's worth a try on the networking side. OP, do you have all the correct ports open in your router for LIVE access?

    could not send message?

    There is a message cap for the amount of messages you can send on Live per day from your console. Perhaps that would be the culprit.

    The support has explained you the way messaging works in details so I can't add more to that, yet you can submit a request to raise the messaging cap on the feedback site, in order to have even other gamers vote for your request:
