Xbox Live Gold region question

I've been thinking of getting a gold subscription because reasons, so beyond sticking with retailers like amazon, newegg and so on, I decide to try and save a few dollars by going the ebay route, so I start searching for prices. 14 day trial codes, 1 month codes, 3 month, 6 month, I see them all, so I decide to look for 12 month codes, and this is where it fuddles my brain a bit.

I see some entries for USA region codes up to 59.99 or slightly lower, but I see ones that are labeled brazil region but also tagged with (VPN required USA). From what I can try to parse, its telling me that to redeem this code if I dare to buy it, I would have to use a VPN on a brazil channel, then redeem my code on my microsoft account to get 12 months like I would if I did it normally with no VPN or differing region code at all

Is this tolerated at all by the microsoft/xbox staff, would this brazil region code fail because whether or not if I use a VPN, my account is a USA region one, or is this a perma-ban'able offense and I should stay away from these brazil region codes forever?
