    Xbox Live enforcement seems to be very lazy, as I have seen, they banned my friend when I reported him saying "gay". Gay's definition

    1. jovial or happy, good-spirited

    2. a homosexual male or female

    3. often used to describe something stupid or unfortunate. originating from homophobia. quite preferable among many teenage males in order to buff up their "masculinity"

    1. "We'll have a gay old time."

    2. "You DO know he's gay. Notice his homoerotic pornography collection."

    3. "Man, these seats are gay. I can't even see what's going on!"

    It could mean any one of those 3. Yet you didn't ask the defendant? You just impeded his freedom of speech(illegal)? What if he was trying to convey a political message? You wouldn't know. You didn't ask. How many cases would have to be reviewed by an actual
    person is sad, when I have seen a person get reported, then 1-2 minutes later he was banned. There is no way that is a person. It seems automated.

    You'll forgive me I hope for not believing that the only comment you made that was 'ban worthy' was the word gay.

    I have a small suspicion, which I hope you'll forgive me for, that you may on occasion send messages which are easily found offensive.

    Here's an example of chat that should be banned

    "Kill yourself stupid **** ****"

    "You are playing as him? Kill yourself"

    Also, if reported shouldn't they look at the chat log for more knowledge?

    Things like when a friend marked as a favorite you reported for calling you "gay" shouldn't be banned.

    A threat of homicide should be banned.

    I've noticed an improvement that can be made.

    Ban all accounts on that Xbox when a com ban has been emplaced.

    They do look at all the chat logs.

    Freedom of speech does not apply to xbox live so nothing illegal happening there.

    Doesn't matter if the message is between friends,if it violates the ToU/CoC then you risk being suspended.

    Any report is investigated which takes time,if someone was suspended a couple of minutes after sending a message then the suspension would of been for something they did weeks ago,it's just a coincidence they got suspended after sending a message.

    It's extremely rare for someone to be issued a instant suspension/ban.

    Why do people believe that? I proved that it was bot. Go ahead send your friend a message like "Kill yourself stupid **** ****" then have him report it. On all four of my accounts, each one of them got a suspension near instantly.

    If you violate the Code of Conduct that obviously, I'm sure it's setup to flag the Xbox Enforcement Team about such actions.

    Only an actual person from the Xbox Live Enforcement Team can impose or remove a suspension or ban on the account.

  10. So you reported your friend for saying gay and now you're complaining because enforcement did their job. The technical definition of many words doesn't always reflect the implication in a comment. Trying to be smart and posting the "official definition"
    isn't going to buy leeway. It's well known that the word can be used in a very inflammatory way despite its less offensive definitions. The fact that you were the one who reported it means you already know that. In fact, you reporting it also bears weight.
    It's sending a message that YOU found it offensive, otherwise it would've... should've... gone unreported.

    I have a few people on my favorites list just so I get a notification when they come online, for several reasons... doesn't mean they're anything more than someone I've met on XBL and it certainly doesn't mean any one of them doesn't have the ability to
    say something offensive or CoC breaking. That's no criteria to base a reported enforcement action on, nor should it be.

    You can post examples of what should/'nt be banned all day if you want, but it's not up to you to decide. It's up to enforcement. Others here have already mentioned how enforcement works. Something tells me that either you, or your friend, aren't telling
    the whole story. Maybe your friend has used that word or others with other people and this time was the clincher for enforcement. Who knows?

    I've also noticed an improvement that can be made.

    If you don't want a friend's account to have action taken against it, don't report them for something that may have an actionable aspect to it.

    Everyone has Freedom of Speech. No contract can take that away from you. It is part of The Bill Of Rights. Under your Xbox Contract, if you acquired the contract outside of the U.S., eg. Australia or NZ, your countries laws govern the interpretation of the
    contract. That's law.

    Freedom of speech means we can chat WITHOUT a written script that has to be approved by Microsoft.

    No one goes on XBL and chats reading a script which needs approving by Microsoft. Microsoft has obeyed The Bill Of Rights in this respect. They can't do this otherwise governments will indicate the clause is void.

    However, Microsoft as any company, can place rules on THE BEHAVIOUR of it's users.

    People may not be as good as controlling the tongue as well as others. Xbox is also for all ages, so you can't expect a 12 year old to be as mature as a person in their 40's. Some people may through a few bad words, on occasion, rarely, only in private,
    a bit more, or heaps.

    Microsoft places rules which help govern behavior which is expected and reasonable. Perhaps people should only "really express themselves" in private party chat with your best friends, rather than doing it an open public lobby where some critical strangers
    may be quick to judge.

    Having abysmal behavior is what gets people banned on Xbox due to code of conduct. Some people can be clueless why they got a banned. If they googled the definition of some of the words in the Code of Conduct, and use their conscience
    (a good one I hope), they should come to an understanding of where they went wrong. If they're willing to accept this or blindly blame Xbox is up to them.

    You really need to lookup what freedom of speach covers. It only restricts the government being able to censor what you say. It does not apply to private networks or companies. This has also already been ruled by the US Supreme court as well.

    Even if freedom of speech did apply to networks or companies, the above mentioned applies. Those who have been on XBL for any length of time should pay particular attention to "obscenity" and "fighting words". In short, no... you can't hide
    behind your freedom of speech and be protected from consequences if you act like an ***.
