Xbox live communication ban

I would honestly like to know where all this research into the communication that people on Xbox make that results in them being communication banned. My girlfriend had someone that she versed in a game on black ops 3, stalk her on Facebook and say abusive
things to her which she reported those messages and she said in reply, nice to know you stalk people and who was communication banned? Not the other person but her instead. Please tell me how someone can get stalked and abused and end up getting communication
banned for it?

Ban was lifted but I cannot do party chat

My xbox one account got a communication ban about 2 weeks ago and it was followed by an xbox live ban 3 days later and now that the xbox live ban was lifted I am still communication banned and I've contacted someone at support and they didn't help me. I've
been banned for 3 days now. Gamertag:

 

Have no clue why I got a communication ban.

Communications bans are not just from voice communications but any form of communications

Communication suspensions are imposed due to inappropriate conduct during communication activities on Xbox Live. This suspension blocks an account from accessing any communication features on Xbox Live, including text messages, voice messages, video communications,

If you respond in a way that violates the code of conduct, you can get suspended just as easily as the one instigating. In the future, it's best to report and/or block the player and not respond at all. Retaliating only puts yourself at risk of a suspension
yourself.

 

So it's okay to be abused and stalked by someone but if you reply saying nice to know you stalk people for a living that's breaching the guidelines? That completely wrong on so many levels. You can't even fight a suspension! There is no protection for the
people who do the right thing you just com ban people for fun it seems like

 

As Theory of Game explained clearly is not upon the xbox user to retaliate or ask for specific bans. The only thing you can do in the event of online harassment is to report the harassing party and if the abuse continues to block them in order to prevent
