    You wouldn't get very far. Freedom of speech does not apply to businesses like Microsoft since they're not part of the government.

    However, when you're using a service such as Xbox Live, you agree to the terms of use and the code of conduct. It's your account and you're responsible for it.

    Failure to follow the rules and you're account is subject to suspension or ban.

    "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government
    for a redress of grievances."

    For your statement it says the GOVERNMENT shall make no law abridging the freedom of speech. It says nothing about a private corporation on their servers policing there servers especially when you agreed to abide by the rules.

    Think of it this way:

    Microsoft wants live to be E for everyone.

    Say you were to walk into Chuck E Cheese which is a kids place and supposed to be E for everyone just like the live services and started cussing at somebody and a worker at Chuck E Cheese asks you to leave would you then scream its my freedom of speech and
    i will say anything i want?

    No i didnt think so at that point it is the companies right to ask you to leave and at which point if you dont they would probably call the police and have you escorted off the property by the police.

    Xbox Live is a privately run network, and before you agree to join that network, Xbox Live tells you the rules and regulations that you need to adhere to. If you don't agree with these rules, you may not use the service.

    There are many different places with rules in place that normally don't affect you otherwise.

    For example, you're free to smoke going around the city, and if you're somewhere in the middle of the desert, no one will stop you to relieve yourself by peeing against a cactus or something like that.

    However, if you enter a public train station, the local rules for that train station may forbid you to smoke and it's also not allowed to pee against the hotdog stand inside the building. The security guards of the train station will have all the rights
    to throw you out.

    Also learn what the "Freedom of Speech" is really about. The Freedom of speech prevents the government and police to stop saying your opinion. No one can (yet) arrest you for saying "Trump sucks" or "Trump is the best president of all time".

    But the Freedom of Speech does not allow you to harass other users on Xbox Live.

    But maybe the great Randall Munroe can explain that to you best in the form of a comic.
