  2. In the past 4 years, have bought upwards of 100 bucks worth of games/DLC via Digital DL. Which I really wish I hadn't and also have another 20 dollar points card which outside the MS store has no monitary value.

Now you modded whatever and lost your purchases. But what about people whos only crime was going online to play a game and randomly winded up in a modded lobby set up by devs, who then reported those people for not reporting them? And even if you quit the
game early and dont get banned, that goes against your rep?? I guess they want to force people into being Rats.

There OP is the REAL crime. Yet you can't defend yourself against it and it's a money maker for people who get others banned in this way, who in turn like sheep often set up another account and spend even more money on live, and digital games. Thus making
modded (Gotcha) dev set-up lobbies is a luckertive bussiness with absolutely no oversite whatsoever. COD randoms is but one example. But EA and others, possibly even console manufactures do it as well.

Thus, I say regardless of ToU we need outside oversite. And for every dev etc who knowenly, or unknowingly implimented, or rewarded in any way whatsoever such scams. Billions in fines or fortifure of holdings, property or anything else of value for each person
scammed would be a good starting point for fines in my Judgment. Jail is simply too good of a place for them. But out on the streets homeless just might teach THEM a lesson about right and wrong.

  3. While I agree that if you mod or cheat your account should be banned, but as for the content you already purchased you should have full access to that albeit nothing that has to do with online gaming. And this comes from Xbox's own ToU

If I have a banned console, can I still access my achievements and content?

If your account has not been banned, you are still able to recover your account on an unmodified console. This includes accessing your purchased content and your profile, with achievements, as it existed prior to the console ban.

So you should be able to use your purchased content but you cant go online with it ever again.

  4. Xbox LIVE, a rip off?

Now if it is banned you should still have access to all content because according to law, you bought it. You paid for it with money thereby to deny you usage is theft

  6. I agree. Denial of use via a service. In this case XBL, for not conducting oneself accordingly isn't thief.

    However.

Denial of use altogether for a purchased item, whether purchased via the service or no, does constitute theif by unlawful taking.

If a game and it's DLC can be enjoyed offline, whether local, system link or via other services apart from XBL. Then that game retains its value to the buyer and as such, whether a physical, or digital copy. It thus Constitutes personal property.

I'll say it here for everyone to read long B4 it even happens.

Hide and watch. Somewhere, some day, some one will bring a case like this to court and just as M got the hammer lowered on them for Windows NOT being allowed on a upgraded HDD. It will happen again and will likely be in excees of 10 x as painful in court
    costs and fines.

Regardless of haw fair or unfair it might seem, when you first sign up for xbox live you have the chance to actually see the rules of the service you subscribe to and you should be aware of the fact that in case of a permanent suspension you will loose everything
that you purchased with that gamertag. So it might seem to be unfair but you are given the chance not to agree with the terms.

Sorry, but Corporate policy does not trump Law. Oh sure they'll spend billions, and have spent billions, lobbying to change things, but politicins/politically appointed justices all get replaced. And all it takes to reverse those billions spent, is for one
person to win a case which afterwords opens up a whole new playing field.

I dont look for that to happen in the US, but I do look for it happen elsewhere which will then force the US, regardless of current law, to have to fully comply with it. Just as Microsoft, Nvidia, Intel, and the US branches of gobernment (Oops) had to do
    before.

Funny how fast things can, and does 'change' eh.

So Electro what you're saying is, MS needs to be punished for denial of use. Never mind that you are handed the terms and conditions of this service every time you make an account. And is easily accessible at any time you want to read it. I'm not entirely
sure what point you're trying to make, lol.

Someone who violated very clear terms and conditions needs to sue MS and win a case because of a denial of use?

    Let's break this down.

    I make an account, I don't read the ToS/ToU

    I violate the ToS/ToU

I try and sue MS for not allowing me access to my account

Because I refused to read the ToS/ToU

Ignorance is no excuse to break the law. And essentially the ToU IS the law for MS accounts.

    ^^ pretty much spot on.

If you lose content as a result of breaking a companies ToU that you agreed to then there's nothing you can do.

When you sign up to live part of what you agree to is that you forfeit any dlc, live time etc. if you are banned for braking the rules.

Also, when you buy digital content (not just through Microsoft but through any online company), you're purchasing a license to use the content, not the content itself. So you're bound by that companies rules concerning the use of that content.

  12. The licence for the game is set to the account you used to purchase the game. Not your Xbox. Your account gets banned, you can't access the game, because you have no licence. You don't like this, buy disk games instead Xbox LIVE, a rip off? :)

Everything has its advantages and disadvantages. Just life.

Lesson in all of this is, don't break the rules. They are all for us to follow. Not just a selected few.

I, as a rule, always read through anything I am accepting. If its from Microsoft, Google, college and Universities etc... I always read it. Otherwise you could miss some important information that may effect you.

  13. Xbox LIVE, a rip off?

If you view the code of conduct on this site, the section in question is the one part that is actually capitalised, so you have no chance of missing it.

I imagine its the same when creating an account, i don`t remember.

  14. Again: Corporate policy does not trump Law.

Yes, and I know that I am in the extreme minority. But if a company is brough to Court, loses and is fined. It is my belief that said companys fines should be retroactive all the way back to the very founding of the company itself.

Why? Because no matter what Country it is in it had to know right from wrong, and should have implimented its policies with that in mind.

As I alluded to before. Microsoft (M) policy on its services. Isn't the question, but developers who >sale< their games on that service is whats in question. So which came up with the notion of removing bought and paid for games from off peoples gaming sytems?
Was it M, EA, Ubi etc?
