    I was put on a suspension for using a cuss word in a message to a buddy. Now what I say to my friends in our messages is no business of Xbox. And there for this gives them no right to spy on what we say to our friends. Now if it was to some complete stranger
    then I would understand but it wasn't and now I can't chat with any friends until 11/9. Eat me Xbox.��

    As Badger stated, you will need to go to the Enforcement website. We on the forums have no influence over the Enforcement Team or insight into their process.

    Anything you do or say over xbox live is Microsofts business,even if it's sending a message to a friend that contains bad language etc.

    You agreed to this when you started your account.

    anything on xbox live is their business there is no freedom of speech on private networks only applies to newspapers and government or public forums private networks has been enforced by the supreme Court itself

    If you read the 1st amendment you would have you're actual answer

    Congress cannot make rules to limit freedom of speech

    This language excludes.freedom of speech in private settings

    Now if you want the supreme Court cases google it

    Private authority Trumps it why do you think you cant curse at workwork or talk about offensively subjects in someone's home and call the cops if they throw you out

    Because anytime you are not on the street but someone's actual property they have the full might of the 1st amendment and the law and the constitution to throw you out or fire you at work you cant call the police or

    Its not rocket science wikipedia

    The 1st amendment isn't one line there are several conditions

    "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress
    of grievances.[1]l

    Pretty sure that's clear cut

  10. I can tell you from experience that law is often not clear cut. However, after doing a little research on this, in this case I agree with you, although I don't believe it has as much to do with the private network as much as the exceptions of the Freedom
    of Speech clause. Certain language like "Obscenity" and "Fighting Words and True Threats" are considered unprotected speech, and it makes sense with Xbox Live because every communications suspension is always a result of people using language against other
    people that falls under either of those two categories.

    If you got a 30 day console ban then that's because you've been suspended several times before or more than one account has been suspended on that console.

    Next time it will be a permanent ban.

    The Microsoft Services Agreement found here...Microsoft Services Agreement contains in part this statement "You should not expect any level of privacy concerning your use of the live communication features (for example, voice chat, video and communications
    in live-hosted gameplay sessions) offered through the Xbox Live/Games for Windows-Live service. We may monitor these communications to the extent permitted by law. However, we cannot monitor the entire Services and make no attempt to do so. You understand
    that others can record and use these communications. Communications in live-hosted gameplay sessions may also be broadcast to others. Some games may use game managers and hosts. Game managers and hosts are not authorized Microsoft spokespersons. Their views
    do not necessarily reflect those of Microsoft."

    There are other parts that are applicable to messaging. Basically anything you say or do can be held against you and failure to follow the COC and TOU can and will result in loss of account, banning of the console and loss of all content tied to that account
    or console. Be an adult, take the higher road, don't retaliate and nothing will happen to you. If you call your "friend" names, you likely will be reported and only have yourself to blame. It isn't the system banning or suspending you, it is your actions and
    behavior.
