    XBox 1 Uploads videos without my permission


    Hi all,

    Just wondering if anyone else is having this issue. I have all of the settings for game recording turned off in the settings, and have never recorded or uploaded anything. The other day I found two clips of soccer goals (from FIFA 14) had somehow been uploaded
    to the uploads app. Thinking it may be a glitch, I got a friend to check his too. He too has the upload and record settings turned off, but had 3 clips uploaded.

    I'm quite concerned about this, if anyone else has these settings turned off I suggest you check your uploads for unauthorized uploads. Hopefully its just my friend and I that have had this happen.

    Direct video uploads to youtube

    The kinect for the xbox 1 should allow you to upload videos directly to youtube without having to upload your video through the upload studio app then having to upload your video a second time to youtube.

    Microsoft are copyright holders of Halo. They can put in a claim to remove Halo 4 videos off YouTube if the uploader has no permission or the video does not fall under fair use. This is what happened when Halo 4 was leaked before release, Microsoft submitted
    an infringement claim and videos of leaked Halo 4 footage was removed.

    After a game has been released, most publishers won't put in infringement claims on videos without permission because it is free publicity and it does not harm them. So you should be fine to upload videos of their games. From what I've read, in October, Microsoft
    changed some terms to not permit monetisation on videos for some of their games including Halo 4. This means if you put ads on your videos they will take it down. I'm not sure if this has since changed, but if you don't put ads on the video it should be
    ok.

    So, to conclude, without permission or fair use, Microsoft have the ability to remove a Halo 4 video from your channel. However, it is highly unlikely it will happen, so you should be completely fine to upload and make Halo 4 videos.

    A lot of people experienced similar after uploading a video. Only thing to do it wait for a reply from the Xbox team that handle these bans/permissions.

    It's more complex than allowing use for walkthrough guides and it's a bit beyond fair use if you're publishing large amounts of video but at the same time it is accepted. You should seek permission from the copyright holder but you can be sure that you
    will not be persued for publishing game video without doing so. Be prepared to take it down if you're asked and as was mentioned do not make a profit selling the gameplay videos you make without seeking permission.

    Also, report the video on YouTube. Things like that can be removed by the request of Microsoft or other companies who can back up a claim that there content is being used without permission.
