XBL enforcement overreach

So, I received an, what I feel to be, unjust ban. It's the first one I've ever attempted to appeal over the years. I've had a few and said, well, ok, probably deserved, and got on with it. The other day I got one, which this discussion
is about, for absolutely no reason. I literally got a ban for a wordstring.

I'm playing this elimination type game with randoms and we're getting creamed. The opponents are good and shots and ours just aren't connecting, *we're team firing surprisingly well, especially considering it's all randoms*, and still just getting smeared.
I send a msg to one of my team mates, just kill yourself. Screw it, I wanted the match over with right, and I mean within 10 seconds, I have a msg from X Box Live. BEFORE the final score animations have even finished. This can only be one thing, and that is
that I have been trolled by XBL enforcement. There's no other possible way for this to have happened. The next day, it gets even worse!! I get an *updated* ban. I will copy/paste all the relevant information here in just a moment.

Needless to say, I'm beyond disappointed in XBL enforcement. You boys/girls need to get out their looking out for kids with mod controllers, running lag switches and other DOS attacks, all of which I've been a victim of multiple times, and quit worrying
about a word string. At the end of the day, anyone can choose to be butthurt over anything. That's why we have a block button. Let's try to not be teaching folks the wrong message, sometimes you need to get so proactive as to hit block and not be such a dang
snowflake.

Here's what happened:

We were getting our butts kicked and I asked the player to kill himself to get the match over with. I can see where that could have been taken out of context and I apologize for that. Completely my mistake but that's a context thing and yes, it was poorly
worded.

Hello BigXDaddyXBaddy,

Thank you for using case review. This account was issued a 14-day communication suspension for encouragement of self-harm and abusive communications via Xbox Live. During this suspension the account may continue to access the Xbox Live service, including online
multiplayer, but communications features will be restricted. This includes messaging, video communications, in-game and party chat, and Skype on Xbox One. At the conclusion of the suspension all communication functionality will be automatically restored.

We can assure you that this suspension was not issued lightly. Suspensions are only issued following a rigorous investigation of the account’s activity and conduct confirming that a Code of Conduct violation occurred. After reviewing your inquiry, we have found
the enforcement to be warranted.

So, ok, whatever. Let it run it's course and then back off to the races right? Nope. Next day, out of the blue, here comes this.

Harassment Abuse and Threats 9/27/2017, 3:01:53 PM Decision Upheld

Enforcement Detail :- This account engaged in harassment, abuse, or threats towards other players. OK, so, my coms got suspended, I filed an appeal, and the next thing I know I get hit with a 2nd consecutive "action", for coms, AFTER I'm already coms banned, and now I cannot play in the multiplayer modes. Tell me how this is not harrassment please.

As a result, I feel that it's fair to lift both bans ASAP. You've shown that you have 0 integrity. Otherwise, when does it end? 2 weeks down the road do you just say "hey, let's ban him again?" What kind of precedent does this set?

Thanks for your inquiry, BigXDaddyXBaddy!

This account had been issued a temporary communications suspension for harassing other players with demeaning language, encouragements of self-harm, and disruptive behavior while on Xbox Live.

Additionally, the subsequent 14-day harassment suspension was deemed necessary due to a failure to correct this extensive pattern of behavior. During this suspension, the account will be unable to access the Xbox Live service, including social features and
online multiplayer. Given this pattern of behavior, we have also revoked this account’s communications privileges for 100 days.

Please note that XBLPET conducts reactive investigations to ensure players are participating in Xbox Live in healthy and positive ways. As the Microsoft Services Agreement has no statute of limitations, this means players may be enforced upon at any time for
past violations provided a violation did indeed take place. Our records indicate that this account has been found guilty of similar violations in the past, which helped establish a clear pattern of negative behavior and shaped our decision when issuing this
latest enforcement as well as the suspension’s duration.

After conducting a thorough investigation and carefully reevaluating our records, we have found the issued enforcements to be warranted. Please understand that future violations of this type may result in more severe enforcement action, including permanent
account suspension and/or console-level enforcement.

Folks, this is scary. This is literally a "who polices the police?" situation. I'd already admitted I'd made mistakes in the past, owned up to it and never challenged them. Challenge it one time and this happens. HOW DARE YOU QUESTION OUR AUTHORITY??!! This
is completely wrong and over the top. Something needs to be done here.

:)

Yeah well some people's definition of FUN is using curse words, trolling people and just all around using...what did you call it? "Poor conduct" lol yeah that doesn't sound self righteous at all. Well if it's not obvious already I have read the code I just
don't agree with it and am fighting to get it changed. Otherwise im going over to PC where there IS NO code of conduct and you can basically do whatever you want anonymously. How things are SUPPOSED TO BE. Lol but you guys keep riding you high horse and feeling
like you're better than everyone with your "unpoor conduct" lol god thats a funny phrase.
