they will deem it as market place theft and perma ban your account and possibly your console too.

As mentioned, most likely this will not end well. If they say they cannot refund you because of their policies, and you understand that it has been more than 14 days, disputing with your bank would be wrong.

I understand where you come from. I once bought a game that had a problem or a game that was " dead " but that is not exactly Xbox/Microsoft's fault, okay? It is the developer's responsibility to make their game playable and enjoyable.

With that in mind, trying to dispute with the bank trying to " get over " the policies, will most likely get your account banned, okay? I understand that this is frustrating, but this should still be adressed towards the developer.

You state the purchase was against a dormant xbox live acoount; be advised that doing a chargeback will likely lock the xbox account as having a past due balance.

I see. No worries, you won't get banned for it either but since it has been chargeback, meaning the funds were returned to his card, your license for the game has been revoked.
