Why do I need to download a X360 game on my XOne, when I already have the disc?

The reason it needs to be downloaded, even if you own the disc, is because each backwards compatible game has it's own BC emulator contained within the digital download. To run each game requires a custom emulator that is built for that title.

On the 360 the Original Xbox games were made to run with a generic emulator that resided on the console. That approach was very limiting and a lot of games never worked with that emulator.

Sorry but that is just the way it is. You'll have to plan with limited internet which title or titles to download. You could also take the console to a friend's house and download from there. Most of the Xbox 360 games are 5-7 GB, not including DLC. The
expectation with Xbox Live on the One is that you will have a minimum of internet support at your location. If you have trouble downloading any BC games how are you able to play Xbox One titles that are 4-5 times the size and must also be downloaded to the
console?

I, too, have had issues purchasing games with gold on xbox.com. However, I have had no problem acquiring the games on my X360 and XONE. I have already downloaded Dirt3 (and minimally played it) on my X360. I will test tonight to see if I can access it
on my XONE. I think the answer to your question is:

1. Download the "Free Games for Gold" on your X360.

2. Then, download the game on your XONE.

I downloaded these before on my X360, I never downloaded them on my XOne. The screenshot is proof that I've purchased with my account.

I don't have this issue with other X360 games (ex: Tomb Raider Underworld and DLCs : OK)

I migrated my account from US to BR (Brazil) and since then I am being charged for X360 titles. My subscription is still valid and the weird thing is I can download XOne games with no charge, but X360 games aren't free.
